5.1.2 - Protection against retaliation

ISO 37001

How to Answer the Question

When explaining how an organization ensures no retaliation against employees for reporting corruption or refusing to participate in it, focus on:

-   Clear Policies:   Outline the organization's written policies that explicitly protect those who report corruption from retaliation. These should include descriptions of what constitutes protected behavior and the consequences for those who retaliate.

-   Reporting Mechanisms:   Describe the secure and confidential channels provided for reporting corruption, such as anonymous hotlines or online platforms.

-   Support Systems:   Discuss the support and resources available to those who report corruption, including legal protection, counseling, and security measures if necessary.

For detailed policies on non-retaliation, refer to the [International Labour Organization’s guidelines](https://www.ilo.org).

Why It's Important

Protection against retaliation is crucial because it:

-   Encourages Reporting:   Ensures that employees feel safe to report corruption without fear of negative consequences, thereby increasing the likelihood that corruption will be reported and addressed.

-   Strengthens Integrity:   Demonstrates the organization's commitment to ethical practices and strengthens the overall integrity of the corporate environment.

-   Complies with Legal Standards:   Meets legal and regulatory requirements that protect whistleblowers and individuals reporting in good faith.

Additional insights can be found in the [UNODC’s good practices for protecting reporting persons](https://www.unodc.org).

Examples

-   Example A:

 -   Context:   A technology firm implements a whistleblower protection program that includes regular training on the importance of reporting and the protections afforded to reporters.

 -   Resources Deployed:   Online training modules, confidential reporting app.

 -   Outcome:   Increased reports of unethical behavior and zero instances of retaliation reported following the implementation.

Learn more about implementing such programs at the [Council of Europe’s Speak Up policy](https://rm.coe.int).

-   Example B:

 -   Context:   A manufacturing company establishes a committee to investigate claims of retaliation and ensure that those who report corruption are not penalized.

 -   Resources Deployed:   Investigation committee, legal support for affected employees.

 -   Outcome:   Effective resolution of few retaliation claims and maintenance of a transparent reporting environment.
